Terms & Conditions

These Terms & Conditions apply to all sales, commissions, collaborations, and use of work by Ingeborg Meulendijks (“the Artist”), unless otherwise agreed in writing. By engaging with the Artist in any professional capacity, you accept and agree to the following terms.

1. Definitions
“Work” refers to all original works created by the Artist, including physical objects, installations, sketches, digital designs, prototypes, and conceptual material.“Client” refers to any individual, institution, gallery, company, or third party commissioning or acquiring work from the Artist.“Commissioned Work” refers to work created at the request of and/or in collaboration with a Client.“Non-commissioned Work” refers to autonomous or self-initiated pieces created independently by the Artist.

2. Ownership and Copyright
All intellectual property rights remain the sole property of the Artist, unless explicitly transferred in writing. This includes (but is not limited to) rights to:– Concept and design– Materials and techniques used– Documentation, sketches, and development files– Photographic and digital representationsPurchase of a physical artwork or commission does **not** grant the Client rights to reproduce, copy, license, or modify the work in any form.If the Client wishes to use images of the work for promotional or commercial purposes, prior written permission must be obtained. Proper credit must always be given to the Artist.

3. Reproduction and Publication
No reproduction of the Artist’s work may be made without written consent. This includes:– Printed materials (books, brochures, catalogs)– Digital content (websites, press, social media, advertisements)– Editorial or educational useThe Artist reserves the right to reproduce images of all works for her own portfolio, website, exhibitions, publications, or promotional purposes, unless explicitly agreed otherwise in a written contract with the Client.

4. Commissions
For all commissioned projects, a written agreement will be drawn up specifying:– Scope of the work– Timeline– Materials and techniques– Budget and payment schedule– Rights of useA non-refundable deposit (usually 30–50%) is required to begin the commission. Final delivery takes place only after full payment has been received.Substantial changes to the brief, timeline, or budget may result in additional fees or adjustments to the original agreement.

5. Shipping and Installation
Shipping, delivery, and/or installation of works is the responsibility of the Client, unless otherwise agreed. The Artist is not liable for damage incurred during transport unless she has arranged the shipping herself.For large-scale installations, spatial works, or site-specific commissions, additional conditions may apply regarding access, insurance, and construction support.

6. Liability
While every effort is made to ensure the highest quality and integrity of materials, the Artist is not liable for:– Normal wear and tear– Misuse, mishandling, or inappropriate environmental exposure– Alteration or restoration by third partiesThe Artist shall not be held responsible for damages, loss, or delays due to force majeure (including but not limited to fire, natural disasters, illness, or transportation issues).

7. Returns and Cancellations
Because each artwork is unique and/or custom-made, all sales are final. Returns or cancellations are not accepted once production has begun.In the case of a Client cancelling a commission after work has commenced, all expenses incurred and time invested up to that point will be invoiced. Deposits will not be refunded.

8. Exhibitions and LoansIf a work is loaned for an exhibition or public presentation, a formal loan agreement must be signed. It must include conditions regarding transport, insurance, display, and duration.The Artist retains moral rights over how and where her work is shown, and may decline participation if these rights are not respected.

9. ConfidentialityAll discussions, sketches, concepts, or designs shared in the course of a collaboration are considered confidential unless publicly released by the Artist or agreed upon in writing.

10. Governing LawThese Terms & Conditions are governed by Dutch law. Any disputes shall be settled in accordance with the jurisdiction of the courts of The Netherlands.
